Legal terms & Conditions

User agreement
The Goldtotem user agreement (Agreement) is a contract between any user and Goldtotem and applies to your use of this e-currency exchange tool and any related products and services available through the website Goldtotem.com. If you do not agree to be bound by the terms and conditions of this Agreement, please do not use or access our services. We may amend this Agreement at any time by posting the amended terms on the site Goldtotem.com. All amended terms shall be effective immediately after they are posted on our site.

General
The user acknowledges and agrees that he is solely responsible to provide valid and accurate information needed to complete the Goldtotem orders.

The user is solely responsible for all payments, even if the instructions provided by the user are incorrect. Furthermore, the user must be aware that any transfer of e-currencies into wrong e-currency accounts due to wrong account numbers given by the user are not reversible. Goldtotem has no power to retrieve e-currency placed in another user account. The user simply must provide the correct account number and other details to prevent this from happening. Further to that, the user must also be aware that providing wrong bank account numbers and other bank account details may either not be reversible or they might result in penalties placed by respective banks.

The online orders are binding contracts between the user and Goldtotem and shall be honored by the user. Payment must be good funds of the exact amount specified in the user's order, net of all fees. If the user fails to remit good funds of the exact amount specified in the user's order, net of all fees, Goldtotem, at its sole discretion, may reduce the order to the amount of funds received. If the user remits more than the amount of good funds necessary to fulfill his order, net of all fees, then Goldtotem, at its sole discretion, may adjust the user's order to the exact amount of funds received.

Concerning the three gold-backed e-currencies (e-gold, Pecunix and 1MDC), the rates provided by our calculators are established in "worth of" the chosen e-currency. This means, the transactions do not depend on the current price of the ounces/grams of gold at the date the user takes his order. Goldtotem cannot be held responsible for the current change rate variation of the three e-currencies, between the date of any user's order and the Goldtotem currency exchange.

All transactions into, out of or between accounts of e-currency providers and banking institutions shall be subject to the Legal terms & Conditions of those providers as outlined on their respective websites or in their rules of conduct and other appropriate regulations.

Payments are final and not reversible. One exception to this rule will be the cancellation of an order that has not yet been processed in the following 24 hours (no cancellation fee).

User's responsabilities
The user is solely and completely responsible for the e-currency account filled in its Goldtotem order, the contents and disposal of their contents. Goldtotem cannot be held responsible for the use or disposal of the value or contents of any e-currency account.

Any tax consequence of Goldtotem orders and transactions are the sole responsability of the user.

Goldtotem will not fulfill any exchange transaction ordered by the user if the user uses or attempts to use the Goldtotem tool in connection with tampering, modifying or otherwise corrupting the security or functionality of the Goldtotem services. Additionally, the user will be subject to damages and other penalties, including criminal prosecution where available and the notification to the general public of the user's actions, at the sole discretion of Goldtotem.

Third party responsibilities
In the unlikely event of a default by any third party involved in the exchange transaction (an e-currency provider, a banking institution or a third party service provider), Goldtotem cannot guarantee an execution of the order. Goldtotem will not be responsible for delays or failures in the transmission, receipt or execution of orders, remittances, payments, or information due to events or systems beyond its control. The obligations of this contract precede any government enactment. Goldtotem's owners, employees, agents or affiliates will not be responsible for any loss, damage or injury resulting from any event or sytem beyond their control.

Compliance regime
Syllage Inc., the company managing the Goldtotem tool, reserves the right to report any fraudulent activity to the appropriate authorities. Payment may not be counterfeit, fraudulent or originated from laundering money. The user agrees that any attempt to remit fraudulent fund will result in prosecution to the fullest extent of the law.

Syllage Inc. reserves the right to refuse service to particular individuals or entities, at our sole discretion, with or without cause. NO correspondence about a such decision.

Syllage Inc. operates independently of e-gold Ltd, Gold & Silver Reserve Inc, Pecunix Inc and Interesting Software Ltd.

Exclusions and Limitations
Syllage Inc. excludes all representations and warranties relating to this website and its contents, including in relation to any inaccuracy or omission in this website.

Syllage Inc. excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised Syllage Inc. of the possibility of such potential loss) or any indiret, consequential and incidential damage.

Goldtotem is independantly operated, and is neither endorsed by, nor affiliated with any currency provider.
